E-commerce agreements with legal status.’


Dear clients, shopping places have been moved to internet marketing with new technologies, and online shopping is increasing day by day. With these innovations, sellers, entrepreneurs or organizations have begun to sell their products on the web sites. New and special obligations have been introduced to organizations along with e-commerce which is the new popular shopping method of today. We will provide information about the legal status of e-commerce contracts and the agreements to be placed on e-commerce sites in this information note.

E-commerce agreements are regulated as ”distance selling agreements” in our legislation. The definition of the relevant legislation is as follows:
‘’written, visual and electronic media or other tools of communication, and without any face to face with consumers, contracts that require immediate or final delivery of the goods ‘‘

This agreement, which is valid after the customer’s approval and completion, provides information about the customer’s rights arising from consumer law and the delivery of the product.

In addition to the above-mentioned contract, there are three more important types of contracts to be included in e-commerce sites.

1. E- commerce web sites’ membership agreement
It is the legal text for the purpose of informing the users about the site and the purpose of informing about the membership and the responsibilities.
2. E- commerce web site’ Privacy Policy
It is basically a legal text on how users’ information is protected. It covers information about security systems such as personal and credit cards, which are generally used for payment purposes.
3. Contact Information
The sites should share the company’s address, telephone and company information in a location where the customers can reach easily on a website. This section is often located at a communication tab on the sites.
