Dear clients, any undertakings’ operations in or affecting markets for goods and services within the borders of the Republic of Turkey is regulated by the ‘’ The Act Of The Protection Of Competition’’. The purpose of this Act is to prevent agreements, decisions and practices preventing, distorting or restricting competition in markets for goods and services, and the abuse of dominance by the undertakings dominant in the market, and to ensure the protection of competition by performing the necessary regulations and supervisions to this end.

Undertakings’ and association of undertakings’ some operations are prohibited by the regulation and these operations have some sanctions too. The operations prohibited by regulation are basically as follows;

1- Distortion or restriction of competition directly or indirectly in a particular market for goods or services are illegal and prohibited.
2- Agreements and concerted practices between undertaking,
3- Decisions and practices of associations of undertakings which have as their object or effect or likely effect the prevention
4- Abuse of Dominant Position
5- Mergers and acquisitions which have as preventing competition in the market for goods or services

These prohibited operations may be exempt ıf have provides the following necessary conditions. This exemption may be granted by the Competition Authority for a specified period or under certain conditions upon application.

1- Ensuring new developments and improvements, or economic or technical development in the production or distribution of goods and in the provision of services,
2- Benefitting the consumer from the abovementioned, 3- Not eliminating competition in a significant part of the relevant market

The commercial operations of the organizations’ effects on the markets for goods and services with care to rules of competition law, helps to protect from Competition Authority’s punishments. The organizations which are affected by these prohibited activities in the markets for goods and services will also be able to remedy the situation with application to the Competition Authority. For these reasons, competition law has an important place in business life and regulates markets. Being aware of the existence of these rules will be beneficial for business life and commercial rights.
